1.2 “App” refers to the tools, widgets, and related services offered on subdomains of hexeum.net, including but not limited to community engagement tools, overlays, and widgets.

1.3 “User” refers to any individual or entity accessing the Services, including, but not limited to, streamers and viewers.

1.4 “Viewer” refers to any individual accessing the Services to engage with content or use the tools provided without actively creating or managing content.

1.5 “Streamer” refers to any User accessing the Services to create, manage, or interact with content as part of their streaming activities.

1.6 “Services” refers collectively to both the Website and the App.

2. Use of Services

2.1 You agree to use the Services only for lawful purposes and in compliance with these Terms and any applicable laws.

2.2 Certain functionalities in the App may require creating an account. By creating an account, you agree to provide accurate information and maintain the confidentiality of your credentials.

2.3 Use of the App’s tools and widgets may require granting us permission to access certain third-party platforms (e.g., Twitch). You are responsible for complying with the terms of those platforms.

3. Updates to the Services

3.1 We reserve the right to update, modify, or discontinue any aspect of the Services (including the Website or App) without prior notice.

3.2 If changes to the Services impact your use, we will provide notice through the Website or App.

4. Privacy

4.1 By using the Services, you acknowledge and agree to our Privacy Policy, which governs the collection and use of your personal information.

4.2 Data collected in the App may differ from data collected on the Website. For example, the App may store user-generated settings and preferences for widgets or overlays.

5. Payment and Subscriptions

5.1 Any purchases made through the Website are subject to the Refunds and Cancellations section of these Terms.

5.2 Some features of the App may be free, while others may require a subscription or one-time payment. Pricing details will be provided within the App.

5.3 You agree to provide accurate billing information and authorize us to charge your payment method for any applicable fees.

6. Tipping

6.1 The Services enable Viewers to send tips or donations (“Tips”) directly to Streamers via Stripe Connect. To participate, Streamers must register with Stripe Connect and agree to its terms.

6.2 Tips are processed through Stripe’s payment system. By using this feature, you agree to abide by Stripe’s terms and conditions, in addition to these Terms.

6.3 We reserve the right to:

• • Change or update the available Tip-payment methods and Payment Providers.

  • Restrict or remove the ability to send or receive Tips for any User or Streamer at our sole discretion.

  • Limit the frequency or amount of Tip transactions permitted through the Services.

6.4 Tips are non-refundable and cannot be withdrawn or charged back by Viewers. In the event of suspected fraudulent activity, we reserve the right to investigate and, if necessary, prevent Streamers from accessing such Tips until the issue is resolved.

6.5 Viewers confirm that:

• • They are using a valid payment method they own to send Tips.

  • Tips are not given in exchange for goods, services, or any promised benefits.

6.6 Hexeum is not liable for:

• • The availability or operation of Stripe’s payment system.

  • Any disputes between Viewers and Streamers regarding Tips.

  • Any unfulfilled transactions due to errors or incorrect payment information provided by the Viewer.

7. Refunds and Cancellations

7.1 Digital Goods Purchases:

• • All purchases of digital goods through the Website are final and non-refundable. Due to the nature of digital products, refunds cannot be provided as there is no way to return the delivered content.

7.2 Subscriptions or Digital Goods:

• • Subscriptions or digital goods purchased through the App are non-refundable, except in cases where the service was not delivered as described or due to technical errors caused by Hexeum.

  • Users may cancel subscriptions at any time, but cancellation will only take effect at the end of the current billing cycle, and no partial refunds will be issued.

7.3 Tipping:

• • Tips sent via the App are non-refundable and cannot be cancelled or charged back by the Viewer.

  • In cases of suspected fraud, Hexeum reserves the right to investigate and take appropriate action, which may include refunding Tips to the original sender or withholding access to the funds by the Streamer.

8. Third-Party Integrations

8.1 Twitch:

The App relies on integrations with Twitch for certain functionalities, such as widgets and tools. By using these features, you agree to comply with Twitch’s Terms of Service and grant Hexeum the necessary permissions to access your Twitch account as described in the App. Hexeum is not responsible for any changes, interruptions, or limitations imposed by Twitch on its services or APIs.

8.2 Stripe:

Payments made through the Services, including Tipping, are processed via Stripe Connect. By using Stripe for transactions, you agree to Stripe’s Terms of Service and privacy policy. Hexeum does not store your payment information; all payment processing is managed directly by Stripe.

8.3 Future Integrations:

As the Services evolve, additional third-party integrations may be added. By continuing to use the Services, you agree to abide by the terms and conditions of any such integrations, which will be outlined in future updates to these Terms.

9. Limitations of Liability

7.1 The Services are provided “as is” without warranties of any kind, whether express or implied.

7.2 We are not liable for any disruptions, data loss, or damages resulting from your use of the Services, including but not limited to third-party integrations used in the App.

8. Termination

8.1 We may terminate or suspend your access to the Services at our discretion, including but not limited to violations of these Terms.

8.2 Upon termination, any rights granted to you under these Terms will immediately cease.

9. Governing Law

The laws of the Country, excluding its conflicts of law rules, shall govern this Terms and Your use of the Service. Your use of the Application may also be subject to other local, state, national, or international laws.
